Fair terms, in plain language.

These Terms of Service (“Terms”) are a binding agreement between you and EmailListChecker, Inc. (“we,” “us”) governing your access to and use of the EmailListChecker website, dashboard, API, and AI assistant (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you're authorized to bind that organization, and “you” means that organization.

You must be at least 18 and provide accurate registration details. You are responsible for safeguarding your password and API keys, and for all activity under your account. Tell us immediately at [email protected] if you suspect unauthorized use. One person or organization per account; don't share credentials to circumvent plan limits.

EmailListChecker is built to protect sender reputation, not to enable abuse. You agree not to:

• Upload lists you don't have a lawful basis to process, or verify addresses to facilitate spam, phishing, or harassment.
• Use verification results to target addresses in violation of CAN-SPAM, GDPR, CASL, or other applicable marketing laws.
• Resell, sublicense, or white-label raw verification capacity without a written reseller agreement.
• Probe, scrape, overload, or reverse-engineer the Service, or circumvent rate limits, credit metering, or security controls.

Verifications are paid for with credits, on a pay-as-you-go or subscription basis as shown on our pricing page.

• Credits never expire. Credits you purchase remain available for the life of your account — we will not silently delete paid balances on a clock.
• You pay for answers.Where the Service genuinely cannot determine a result, we don't charge a credit for it.
• Money-back guarantee.If a list we mark deliverable doesn't reduce your bounce rate as described, contact us within 30 days for a refund of the credits used, subject to our published guarantee terms.
• Subscriptions renew automatically until cancelled; you can cancel anytime and keep access through the paid period. Taxes may apply.

API access is subject to the rate limits and quotas on your plan. We may throttle or pause requests that risk platform stability, and we version our API so integrations don't break without notice. Deprecations are announced with a reasonable migration window. You are responsible for securing your API keys and for traffic they generate.

The Service, including its software, design, and brand, is owned by us and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You retain all rights to the lists and content you upload; you grant us only the limited license needed to process and return verdicts, as described in our GDPR & Data Processing document.

We target a 99.9% uptime SLA and publish status at our status page. Eligible plans receive SLA credits for sustained downtime as described in your order. We provide support by email to all customers and prioritized support on paid plans.

Email verification is probabilistic by nature: mail servers change, catch-all and greylisting behavior shifts, and no provider can guarantee a specific deliverability outcome. The Service is provided “as is” and “as available,” without warranties of any kind beyond those expressly stated here or required by law. We are honest about confidence and never present an unknown result as a certainty.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

You can close your account anytime from the dashboard. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. On termination you can export your data during a short grace period, after which it is deleted per our retention policy.

We may update these Terms as the product and law evolve; material changes are announced in-app and by email before they take effect. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and disputes are subject to the courts located there, except where local consumer law gives you additional rights.
